Zeal Capital Market (Seychelles) Limited, includes its subsidiaries and affiliates (henceforth “Zeal”) are committed to hold, treat and use information that is not publicly available (henceforth “Data” received from you in a confidential manner.

This Personal Data Collection Notice (henceforth “Notice”) is to bring to your attention the following:

  1. Type of Data (that can be) collected and processed by Zeal;
  2. How Zeal uses the Data;
  3. Disclosure of Data;
  4. The manner of Data record keeping; and
  5. Your right to access or limit Zeal’s right to access to the Data.

Type of Data Collected and Processed by Zeal

Before Zeal provides any services to you, Zeal may collect the following Data from you:

  1. Name;
  2. Identity card number or passport number;
  3. Date of birth;
  4. Tax Identification Number;
  5. Citizenship;
  6. Gender;
  7. Address;
  8. Civil status;
  9. Occupational;
  10. Personal contact number;
  11. Company registration information;
  12. Company website(s);
  13. Email address;
  14. Personal/Business bank account detail(s);
  15. Total annual income;
  16. Experience in trading currencies, securities, options, commodities, futures and/or PTC bullion or OTC foreign exchange;
  17. Proof of income/Source of fund or wealth;
  18. Country of tax residence;
  19. Property sale document(s);
  20. Investment gains document(s);
  21. Inheritance document(s);
  22. Company sale document(s);
  23. Divorce settlement document(s); and/or
  24. Lottery or gambling win receipt(s).

For you to enjoy the full benefits of Zeal’s services, Zeal may (depending on circumstances) collect other Data that may be crucial to provide Zeal’s services.

How Zeal uses the Data

Zeal only uses information held about you in the following ways:

  1.  To provide you with products and services that you request from Zeal or, where you have consented to be contacted, for products and services that Zeal feels may be of interest to you; 
  2.  Managing and administering the products and services provided to you; 
  3.  Keeping you updated as a client in relation to changes to Zeal’s services and relevant matter(s); 
  4. To carry out Zeal’s obligations arising from any contracts entered between you and Zeal.

Disclosure of Data

Depending on the products and services concerned and the relevant restrictions on sensitive data, the Data may be disclosed to:

  1. Member of Zeal’s group; 
  2. Potential successors in title to Zeal; 
  3. Third party consultants, contractors, or other service providers who may access the Data in the course of providing services to Zeal, including but not limited to:
  4. SumSub, a verification platform, for the purposes of remote identity verification, fraud prevention, enforcement of anti-money laundering and counter-terrorist financing laws and regulations, internal risk management, and due diligence procedures;
  5. Acuity, a global economic calendar service provider, to deliver real-time economic event information;
  6. Zotapay, a payment gateway service provider, to facilitate payment processing solutions;
  7. GlobalDots, an IT solutions provider, to support the company’s technology infrastructure and services;
  8. Etech, a payment gateway service provider, to enable payment processing solutions; and
  9. Sentvia, a payment gateway service provider, to support payment processing activities.
  10. Introducing brokers with whom Zeal has a mutual relationship (any of whom may be within or outside the European Economic Area); 
  11. Any organisation or person acting on your behalf to whom you request Zeal to provide information, including your financial advisor, broker, solicitor or accountant; 
  12. Third parties where it is necessary to process a transaction or provide services you have requested; 
  13. To a Trade Repository or similar; 
  14. Credit providers, courts, tribunals and regulatory authorities in response to legal and regulatory requests, as agreed or authorised by but not limited to Part IV of the Data Protection Act 2002 and Section 32 of the Financial Consumer Protection Act 2022; 
  15. Auditors or contractors or other advisers auditing, assisting with or advising on any of Zeal business purposes, in any jurisdiction where Zeal operates; 
  16. At your request or with your consent.

The Manner of Data Record Keeping 

In accordance with Section 31 Financial Consumer Protection Act 2022, Zeal holds personal information in a combination of secure computer storage facilities and paper-based files and other records and take steps to protect the received Data from misuse, loss, unauthorised access, modification or unauthorised disclosure.

Zeal limit access of information only to those relevant employees or partners that need to know the information to enable the carrying out of the contractual obligation.

Zeal has procedures in place regarding how to safeguard and use the Data. Zeal will not keep the Data longer than is required by the relevant regulations. However, if Zeal considers that any Data is no longer needed, Zeal will remove the same.  

While Zeal commits to use all resources to safeguard your Data, however you shall acknowledge that the use of the internet is not entirely secure and for this reason, you understood, acknowledged and accepted the risk of Data leakage that is beyond Zeal’s reasonable control.

Type Of Data Collected and Processed by Zeal Your Right to Access or Limit Zeal’s Right to Access to the Data

You have the right to reject the request of Zeal in collecting, processing, and use of your Data in accordance with this Notice. You may also revoke your previous consent given to Zeal anytime by contacting Zeal’s customer service at cx@zfx.com. However, should you decline to consent on the collection and use of Data, Zeal may not be able to provide you with the services.

You also have the right to obtain a copy of any personal information which Zeal holds about you and to advise Zeal of any perceived inaccuracy subject to Section 28 of the Data Protection Act 2002.

You also have the right to be forgotten, i.e. the right to ask Zeal to delete or otherwise dispose of any of your personal data that Zeal hold.

You may also contact us to voluntarily allow the disclosure of your personal data for third-party use. In such cases, we may require you to sign the necessary documents before proceeding with the disclosure.

Zeal may charge an administrative fee to cover the cost of verifying the application and locating, retrieving, reviewing and copying any material requested by you.

Further Amendment

Zeal may from time to time, post amendments to this Notice on Zeal’s website and if you continue to use Zeal’s service, you shall be deemed to accept such amendments.
